Procedure for suspension of the validity of issued documents on conformity assessment by the conformity assessment body

The validity of the issued documents on conformity assessment shall be suspended by the conformity assessment body:

1. by mutual agreement between the conformity assessment body and the applicant, with the exception of the termination of the production of this product, service, process;
2. based on the negative results of the periodic evaluation of certified products, services, processes, if, through corrective actions agreed with the conformity assessment body, the applicant eliminates the detected inconsistencies and confirms without additional tests (checks) the compliance of the product, service, process with the requirements established by technical regulations, standardization documents;
3. if there is a notification of changes in the design (composition) of products or the technology of its production, which do not affect the indicators certified during certification before conducting full or partial tests or assessing the state of production, provision of services, process;
4. changes (non-fulfillment) of the requirements of the production technology, if these changes do not cause non-compliance with the requirements checked during certification;
5. in the case of the availability of confirmed information from state bodies exercising state control and supervision in the field of technical regulation on the non-compliance of products, services, processes with the requirements established by technical regulations, standardization documents, if, through corrective actions agreed with the conformity assessment body, the applicant can eliminate the detected inconsistencies and confirms without additional tests (checks) compliance of products, services, processes with the above requirements;
6. in case of non-compliance of products, services, processes with the requirements established by technical regulations, standardization documents, if, through corrective actions agreed with the conformity assessment body, the applicant eliminates the detected inconsistencies and confirms without additional tests (checks) the compliance of products, services, processes with the above requirements.

The procedure for termination of the issued documents on conformity assessment by the conformity assessment body

The validity of the issued documents on conformity assessment shall be terminated by the conformity assessment body:

1. by mutual agreement between the conformity assessment body and the applicant in connection with the termination of production of this product, service, process or for other justified reasons;
2. based on the negative results of the periodic evaluation of certified products, services, processes, if the identified non-compliance is irreparable or additional tests (checks) of the compliance of the product, service, process with the requirements established by technical regulations, standardization documents are required;
3. if there is a notification of changes in the design (composition) of products or the technology of its production, which affect the indicators certified during certification before conducting full or partial tests or assessing the state of production, provision of services, process;
4. in case of non-compliance of products, services, processes with the requirements established by technical regulations, standardization documents;
5. if the applicant does not fulfill its obligations to the conformity assessment body established by the conformity assessment scheme (periodic assessment) provided for by the concluded contract;
6. if the applicant has not complied with the requirements of paragraphs 3, 6, 7 of paragraph 5.1 of these Instructions during the period of suspension of the document in the field of confirmation of conformity;
7. in case of availability of confirmed information from state bodies, exercising state control and supervision in the field of technical regulation on the non-compliance of products, services, processes with the requirements established by technical regulations, standardization documents, if the identified non-compliance is irreparable or additional tests (checks) of compliance of products, services, processes with the requirements established by technical regulations, standardization documents are required;
8. in the event of a change in the standardization document, the method of control and testing, the management system, the design (composition), the completeness of products, the organization and (or) the technology of production of products, services, process without appropriate notification or approval of the conformity assessment body;
9. in the event of a change in the standardization document, method of control and testing, management system, design (composition), completeness of products, organization and (or) production technology, changes (non-compliance) with the requirements of the production technology, if these changes cause non-compliance of services and service conditions with the requirements verified during certification.

Decision to suspend or terminate the conformity assessment document

The decision to suspend or terminate the conformity assessment document is made by the conformity assessment body in the technical regulation information system with the appropriate entry in the register of the state technical regulation system, to account for the issued documents in the field of conformity assessment and is drawn up in the form in accordance with Appendix A, and notifies in writing applicant, consumers, authorized body and interested certification participants.

In case of termination of conformity assessment documents, the conformity assessment body sends information about their termination to the authorized body in the information system of technical regulation.

The decision to suspend the certificate of product conformity for the period of development and implementation of corrective measures agreed with the conformity assessment body is made if, by means of corrective measures, the applicant eliminates the identified discrepancies and confirms the conformity of the product with the requirements of the technical regulation. If this is not possible, the product conformity certificate is terminated.

When suspending the certificate of conformity of the OPS products:

1. makes a decision to suspend the validity of the certificate of conformity of products and temporarily prohibits the use of a single mark of circulation;
2. enter information on the suspension of the certificate of conformity of products in the register of technical regulation;
3. establishes the term for the applicant to carry out corrective measures;
4. controls the implementation of corrective measures by the applicant.

When suspending the validity of a product conformity certificate, the applicant:

1. identifies and determines the quantity of products that do not meet the requirements of the technical regulation;
2. develops and ensures the implementation of corrective measures to eliminate identified non-conformities;
3. notifies, in accordance with the procedure established by the legislation of the Member States, consumers about the danger of using (exploiting) products;
4. informs the CAB in writing about the completion of corrective actions.

After the applicant has carried out corrective actions of the OPS:

1. makes a decision on the renewal of the certificate of conformity of products and permits the use of a single mark of circulation;
2. enter information on the renewal of the certificate of conformity of products in the register of technical regulation.

The decision to terminate the certificate of product conformity is made if the applicant does not eliminate the identified discrepancies and their causes, as well as if there is a danger of using (exploiting) the product.

If it is necessary to suspend, renew or terminate the issued certificate of conformity of products at the initiative of the applicant, the applicant sends a corresponding application to the CAB (with reasons). Together with the application, a product conformity certificate and documents that are the basis for suspension, renewal or termination of the issued product conformity certificate are submitted.

The CAB makes a decision to suspend, renew or terminate the validity of the issued product conformity certificate.

If the applicant decides to renew the product conformity certificate after its suspension, at the request of the applicant, the certification body makes a decision to renew the specified certificate of conformity after a periodic assessment of certified products.

CAB enters the relevant information on the suspension, renewal or termination of the product conformity certificate in the register of technical regulation.

The certificate of conformity of products is suspended, renewed or terminated from the date of entering the relevant information into the unified register of issued certificates of conformity and registered declarations of conformity.
